Heard learned counsel for the applicant wife. The record shows that the respondent though served on two occasions on both the addresses, failed to remain present. The applicant wife is seeking transfer of HMP No. 293 of 2021, pending before Civil Judge (S.D.) Jalgaon, which has been fled by the respondent - husband for restitution of conjugal rights, to the Family Court, Bandra, Mumbai.

The learned counsel for the applicant - wife submits that the applicant as well as respondent are serving at Mumbai, but the husband has fled the aforesaid marriage petition only to harass his wife. In view of the same and for the reasons mentioned in the application, following order is passed.

ORDER

I) The application is hereby allowed and the HMP No.293 of 2021 pending before the learned Civil

2 960 mca 56-22 Judge (S.D.) Jalgaon is transferred to Family Court, Bandra, Mumbai.

II) After such transfer the Family Court, Bandra, Mumbai is directed to issue notice to the respondent- husband.

III) Miscellaneous civil application is accordingly disposed of.
