The civil application and its annexures would show that there is settlement between the parties. In view of that, the appellant is allowed to withdraw the first appeal. 3.

First Appeal (Stamp) No. 35701 of 2013 and the civil application accordingly stand disposed of.

The amount deposited by the appellant be allowed to withdraw in terms of the compromise filed in MACP (D) No. 212 of 2011.
