Both the learned Advocates for the parties mention that the matter is already settled between the parties. In view of the settlement, the proceeding bearing No. Cri.M.A. No.1262 of 2018 pending before the Court of Judicial Magistrate, First Class, Beed is already withdrawn. This petition is arising out of said proceeding.

The proceeding before the Trial Court itself is now withdrawn and in view of this the petition has become infructuous. 03.

The settlement is already taken on record.

Insofar as amount of Rs.30,000/- that is lying in this Court deposited by the husband is concerned, in view of the compromise it is decided that it would be respondent-wife, who would be entitled to receive

( 2 ) crwp277.21 the amount that is deposited in the Court by the petitioner-husband. The respondent-wife is at liberty to withdraw the amount deposited Cri. W.P. No. 277 of 2021 in this Court.

The order passed below Exh.1 in Cri.M.A. No.1262 of 2018 is taken on record and marked "X" for the purpose of identification. 06.
