PER COURT:

1] Heard learned counsel for the applicant and learned AGP for the State. Despite service of notice, none appears for respondent No. 2. 2] Perused the application and impugned judgment and award passed by the learned Reference Court. The Executive Engineer, Minor Irrigation Division, Beed, was party respondent to the original proceeding i.e. LAR No. 396 of 2006. The applicant GMIDC is intending to file an appeal through the Executive Engineer, Minor Irrigation Division, Beed, who was party respondent in the original proceeding. In such circumstances, there is no impediment to grant permission to the applicants to present an appeal against the impugned judgment and award passed by the Reference Court alongwith an application for condonation of delay. Hence, the application stands allowed in terms of prayer clause (B). 3] Leave to file appeal is hereby granted.

4] Registry to take requisite steps for further process. On registration of appeal, list the same in due course. Civil application is accordingly disposed of.
