This matter was heard for some time. The learned advocate for the appellant sought a pass over to take instructions. 2.
After this matter was called out post lunch, the learned advocate submits that about seven witnesses have already been examined before the trial Court as in May, 2020. The learned prosecutor submits, on instructions gathered during the lunch recess, that the defence has been seeking adjournments and on account of the adjournments sought, no witness beyond the seven already examined, could be examined in the last about ten months. 3.
The learned counsel for the appellant submits, on instructions, that the appellant desires to withdraw this appeal, with
905-CrApl-96-21.odt a request that the trial may be expedited and if possible, evidence may be recorded either physically or through video conferencing, within three months.

In view of the above, this appeal is disposed off as withdrawn.

The learned Additional Sessions Judge, Vaijapur is requested to decide Sessions Case No. 65 of 2015, as expeditiously as possible and in any case on or before 31-08-2021. The recording of oral evidence shall be completed on or before 30-06-2021 and the oral arguments should be completed on or before 15-07-2021. In the event of any difficulty in recording evidence physically, the trial Court is at liberty to record evidence even through video conferencing or by such modes as are permissible in law.
