BENCH AT AURANGABAD 944 CONTEMPT PETITION NO.185 OF 2022 IN WP/4840/2021 PANDIT VITTHAL KANODE

VERSUS

GANPAT MORE ....

Mr H. V. Patil, Advocate for petitioner;

Mr S. K. Tambe, A.G.P. for respondent CORAM : RAVINDRA V. GHUGE AND ANIL L. PANSARE, JJ.

DATE : 28th June, 2022 PER COURT:

1.

The learned A.G.P. has placed on record a compilation of six pages, which are collectively marked as 'X-1' for identification. The first page of 'X-1' is dated 24/05/2022, by which, the Deputy Director of Education, Latur, the sole respondent herein, has intimated the decision taken to the Education Society. The details of the hearing conducted and the reasoned order passed is annexed to the said communication dated 24/05/2022.

2.

The learned Advocate for the petitioner submits that, though the respondent has complied with the directions of this Court, the

185.22cp (2) decision arrived at, is prejudicial to the interest of the petitioner and he would, therefore, challenge the same, by filing a writ petition. He submits that this contempt petition can, therefore, be disposed off.

3.

The learned A.G.P. submits that the respondent has tendered an unconditional apology.

4.

As such, this petition is disposed off.

5.

Needless to state, the petitioner is at liberty to challenge the decision at 'X-1'. All contentions are kept open. (ANIL L. PANSARE, J.) (RAVINDRA V. GHUGE, J.) sjk
