1) Heard both the sides.

2) It appears that no application for furlough is filed and no order is made as yet which can be challenged in the proceeding like the present one. The petitioner is interested to get order of furlough in which he is directed to give only personal recognition bond and or he is

2 Cr WP 289 of 2015 directed to give P.R. and cash security. It is contention of the petitioner that he is not in a position to give bonds of surety. He wants to rely on some decisions given by this Court, copies of which are annexed.

3) It is made clear that as no application is made and no order is made of furlough, the present proceeding is not tenable. However, the authority is expected to consider decisions. The authority is expected to consider the application sympathetically as the petitioner has been behind the bars since 2001 and it appears that on not a single instance he was granted furlough. Liberty is given to the petitioner to approach this Court again if he feels aggrieved by the order. The petition stands disposed of. Authenticated copy to both the sides. Fees of the learned counsel appointed for the petitioner is quantified at Rs.1500/-.
