IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.2891 OF 2018 (Suresh Kashinath Bidave and others Vs. Vardhaman Dipchand Gangwal and others) Mr.S.S.Chapalgaonkar, Advocate for the petitioners. Mr.A.P.Bhandari, Advocate for respondent Nos. 1 to 3. Mr.V.S.Badakh, AGP for respondent Nos. 5 and 6. ( CORAM : RAVINDRA V. GHUGE, J.) DATE : 21/03/2018 PER COURT :

1.

I have considered the submissions of Mr.Chapalgaonkar, learned Advocate on behalf of the petitioners, Mr.Bhandari, learned Advocate on behalf of the respondents and the AGP on behalf of respondent Nos. 5 and 6.

2.

An interlocutory order declining to grant temporary injunction to the appellants in RCA No.46/2017 is the subject matter of this petition. The appeal has been preferred on 17/04/2017 by these petitioners, who are the original plaintiffs. Considering the rival contentions of the parties at an interlocutory stage would virtually amount to entering into the dispute between the parties when the appeal is still pending. In my view, ends of justice would be met by expediting the appeal so as to have it adjudicated upon expeditiously. khs/MAR.2018/2891-d

3.

Considering the above, this petition is disposed of and the Appellate Court is called upon to decide RCA No.46/2017 as expeditiously as possible and preferably on or before 31/08/2018. ( RAVINDRA V. GHUGE, J.) khs/MAR.2018/2891-d
