The petitioner is seeking correction of the school record. His request has been turned down by respondent No. 2, the Education Officer (Secondary), by the communication dated 10.02.2025, on the ground that he cannot exercise the power under Clause 26.4 of the Secondary School Code, 1977, since the petitioner has already left the school. However, in fact, he ought to have consider the proposal in light of full bench decision of this Court in the matter of Janabai d/o Himmatrao Thakur Vs. State of Maharashtra and Ors.; 2019 (6) Mh.J.J. 769.

The writ petition is partly allowed. The impugned order is quashed and set aside. Respondent No. 2, the Education Officer (Secondary), shall consider the same proposal afresh on its own merits and in light of the decision in the matter of Janabai d/o Himmatrao Thakur (Supra), as expeditiously as possible, and in any case, within five (05) weeks.
