The applicant is seeking withdrawal of entire amount of compensation, which has been deposited by the appellant-acquiring body. It is to be noted here that the appellant-acquiring body has deposited only 75% of the compensation amount.

{2} body has opposed the application on the ground that the Reference Court has granted 9 times more enhancement than granted by the SLAO.

In view of the same, the applicant is permitted to withdraw the entire deposited amount along with interest accrued thereon i.e. 50% on furnishing usual undertaking and 25% by furnishing solvent surety/security to the satisfaction of Registrar (J) of this Court.

Civil Application is disposed of.

{3} CIVIL APPLICATION NO. 5188 OF 2022 IN Applicants Respondent Mr. N. D. Sonawane, advocate for the Respondent. Heard rival submissions.

The applicant-acquiring body is seeking condonation of delay of 654 days which appears to be caused due to obtaining approvals at various stages. There is no strong objection from the respondent-claimants. Hence, by considering the statutory right of the applicant, delay of 654 days stands condoned. Appeal be placed for admission after removal of offce

{5} CIVIL APPLICATION NO. 5189 OF 2022 IN Applicants Respondent Mr. N. D. Sonawane, advocate for the Respondent. Since the appellant-acquiring body has deposited the amount of compensation, as directed by this Court, the Civil Application is made absolute in terms of prayer clause {B} and disposed of.
