This is regular bail application in connection with Crime No. 875/2023 registered with Shrigonda Police Station, District Ahmednagar for the offences punishable under Sections 304-B, 306, 498-A, 323, 504, 506 r/w 34 of IPC and under Section 3 and 4 of the Dowry Prohibition Act.

First information report indicates that the applicant was married to Vaishali in April, 2019. It is further alleged that the dowry was received at the time of marriage by the applicant. It is further allegation that the applicant and his parents started causing harassment to Vaishali for bringing money from her father. On 11/10/2023 Vaishali was brought to her parental home by her father-in-law. At that time demand of Rs.3 lakhs was made for purchase of Pick-up vehicle. Thereafter on

17/10/2023 it was informed by the Vaishali to her parents about the harassment caused to her. On the next day she committed suicide. Hence, offence came to be registered against applicant and others. He is arrested in November, 2023.

Learned counsel for the applicant submits that now investigation is complete with file the charge-sheet and as such there is no propriety in keeping the applicant behind the bars. It is his submission that applicant has no criminal history and he is not likely to abscond.

Learned APP opposed the application by citing the seriousness of the crime.

Since the investigation into the crime is already over and charge-sheet is filed, the apprehension of interference in the evidence do not sustain. Undisputedly there is no criminal history against the applicant. He is permanent resident of Taluka Shrigonda, District Ahmednagar. He is not likely to flee from justice. Hence application is allowed. Hence the following order.

ORDER

(i) Applicant in connection with Crime No. 875/2023, registered

with Shrigonda Police Station, District Ahmednagar for the offences punishable under Sections 304-B, 306, 498-A, 323, 504, 506 r/w 34 of IPC and under Section 3 and 4 of the Dowry Prohibition Act be released on bail on furnishing PB and SB of Rs.15,000/- (Rupees Fifteen Thousand Only) with one solvent surety in the like amount. (ii) He shall not contract the witnesses directly or indirectly. (iii) He shall not interfere with the evidence in any manner whatsoever.
