IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 52 SECOND APPEAL NO. 448 OF 2002 PARSHAAVANATH PRABHU DEVASTHA BY ITS TRUSTEE & ORS

VERSUS

THE STATE OF MAHAA & ORS

CORAM:

VIJAY S.KULKARNI REGISTRAR (JUDL) DATED:

12/04/2017 The office note indicates that the notice issued to appellant no.2 Shantilal Pitambar Shah returned unserved on the ground that he is reported to be dead. The bailiff report filed on record dated 15/09/2015 clearly indicates that Shantilal Shah expired in the year 2011. It is seen from the record that there are two appellants. The appeal against appellant no.1 Raichand Rupchand Doshi is already dismissed by the order of the court dated 22/11/2010. In view of the above, I find no difficulty to pass following order.

ORDER

The appeal against appellant no.1 Raichand Rupchand Doshi and appellant no.2 Shantilal Pitambar Shah stands abated. REGISTRAR (JUDL) sa484.02(52)
