Mr.Narwadkar, learned counsel for Respondent No.3 on instructions states that the Respondents have also demolished the other construction of which the grievance was made by the petitioners.

Learned counsel submits that the petitioners had sought permission to repair the houses which were partially demolished for widening of the road without charging any amount. According to the learned counsel, application is made on 6.12.2014, however, the Respondents are charging amount as if it is a fresh construction. The Respondent No.3 shall reconsider the application of the petitioners for repair of the houses and take decision upon it afresh, preferably within two (2) months.

The Writ Petition is disposed of. No costs.
