Respondent no.2 is mentally retarded person and even in pending Special Civil Suit No.29 of 2015 he is implicated as a party defendant No.2 under the guardianship of his natural mother. Learned counsel for the applicants has submitted the certified copy of the Special Civil Suit No.29 of 2015. The same is taken on record. On perusal of the same, it appears that the respondent no.2 is shown under the guardianship of his natural mother as a party defendant no.2.

In view of above and for the reasons stated in the application, civil application is allowed in terms of prayer clause "B" and disposed of.
