PER COURT :

1) Heard. The State has filed the present appeal in exception to the order dated 4.2.2011 passed in LAR No. 210/1998 by 2nd Jt. Civil Judge, Senior Division, Ahmednagar. The delay of 602 days has occurred in filing the appeal. The State by the present application is seeking condonation of delay so caused. It is contended that in complying the procedural aspects, the delay has occasioned.

However, it is unintentional.

2) The learned Counsel appearing for the original claimants has strongly opposed for condoning the delay.

3) Considered the submission made by the learned Counsel for the parties. For reasons stated in the application for occurrence of the delay, which according to me are just and sufficient, the delay occasioned in filing the appeal is condoned. The Civil Application stands disposed of.

4) The appeal be registered in accordance with law.
