The learned counsel for the Applicant submits that since the file was missed, he could not appear before the Court when the matter was called out.
The learned counsel for the contesting Respondent submits that this is the fourth time the Applicant is seeking restoration of the appeal and every time, the Applicant and his counsel remain absent when the matter was called out for hearing.
In the light of the above submissions, I do not find any substance in the submissions made on behalf of the Applicant and there was no reason for the counsel to remain absent before the Court on the ground that the file was missing. There is no substance in the application. The Civil Application is hereby rejected.
