The learned Counsel for the applicants submits that the applicants were not knowing about pendency of the present appeal and after death of the original appellant - Kashiram, they came to know about pendency of this appeal from the agriculturists who have preferred the appeals before this Court.

I have also heard learned A.G.P. for respondents No.1 and 2 and learned Counsel for respondent No.3 - acquiring body. 4.

In view of submissions made, the application is allowed in terms of prayer clauses (B) and (C).
