The applicant is seeking bail in Crime No.125 of 2022 registered with City Chowk Police Station, Aurangabad for the offence punishable under Section 307, 323, 504 r/w 34 of Indian Penal Code. The applicant is languishing in jail since 02.05.2022. The injury caused to the injured is simple. The weapon allegedly used in the crime has been recovered. The charge sheet has also been filed. There are no antecedents to his discredit. Considering this fact, the Court is of the view that it would be inappropriate to keep him behind bar. Hence, the following order :

ORDER

(i) Bail Application is allowed.

918-ba-370-2023.odt (2) (ii) The applicant, Zuber Khan s/o Jafar Khan, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime No.125 of 2022, registered with City Chowk Police Station, District Aurangabad for the offence punishable under Section 307, 323, 504 read with Section 34 of the Indian Penal Code, on the conditions that he shall not tamper with the prosecution witnesses. (iii) The applicant shall not threat the injured and the eye witnesses. (iv) The applicant shall attend the trial on each and every effective date of hearing.
