The sole appellant is seeking bail. On perusal of the judgment and depositions recorded at the trial stage. We found that in this case the prosecution placed reliance on circumstantial evidence which is generally known as last seen together with the deceased. This circumstance was only circumstance on which the prosecution's case rested.

The prosecution evidence does not indicate that the victim Umesh was seen last with the appellant Sagar.

During the trial the appellant was on bail.

In view of this, we are inclined to release the accused/appellant on bail of Rs.15,000/- with one surety in like amount. The bail bonds shall be executed in the Trial Court.

The application is accordingly allowed and stands disposed of.
