Learned Counsel for the petitioners, upon instructions, makes a motion to withdraw the petition, with liberty to take recourse to appeal under the Protection of Women from Domestic Violence Act. Motion stands granted. Criminal Writ Petition stands dismissed as withdrawn. However, it is clarified that petitioners will be at liberty to question the original order of Magistrate refusing certain benefits under the D.V. Act in an appeal.
