PER COURT :- Learned counsel appearing for respondent, on instructions informs that, the tender was floated on 28.1.2016 and the last date prescribed for submission of tender form was 19.2.2016. However, the said date was required to be extended up to 1.3.2016. It is informed that, since there was poor response to the tender notice, the date of submission of the tender-form was further required to be extended up to 10.3.2016 and wide publicity was given to the decision, directing extension of the last date for submission of the tenders. It is further pointed out that,

{2} wp 2363.16.odt on evaluation of the technical bids, it is found that, the bidders have not tendered sufficient documents and as such, commercial bids were not opened. The petitioner also does not meet with technical qualifying requirements.

Considering these aspects, the respondent has decided to cancel the earlier tender process and float a fresh tender notice in accordance with MSETCL norms.

In view of the explanation tendered on behalf of the respondent, the challenge raised by the petitioner to the tender notice does not survive.

With liberty to petitioner, to avail of remedies available in law, on publication of fresh tender notice, and in the event cause subsists, the writ petition stands disposed of. (K.K. SONAWANE, J) (R.M.BORDE, J) vbd
