Applicants seek grant of regular bail on account of his arrest in Crime no.0027 of 2025 registered at M.I.D.C. Latur Police Station, District Latur for offence under Sections 309-4 read with Section 3(5) of the Bharatiya Nyaya Sanhita.

Pointing to the date of arrest of the applicant as 16.01.2025, learned counsel for the applicant submitted that applicants are falsely arrested. That, apparently, FIR is against unknown persons. Learned submitted that story narrated by informant is improbable. That, initially he reported to be in possession of Rs.2,00,000/-. That, Rs.1,50,000/- were kept in his WagonR Car. That, surprisingly cash was said to be lying there since 01.01.2025 to 14.01.2025. This is not believable . That, now investigation is almost over, and when nothing is to be recovered or discovered at the instance of applicant, and mere formality of filing of the charge-sheet is remained, learned counsel seeks grant of bail.

Learned APP opposed on the ground that there is CCTV footage. That, applicants are named in the FIR. That, they have criminal antecedents, and as many as seven crimes are registered against accused No.1 and three crimes are registered against accused No.2. That, one more associate of applicants is still absconding, and for all above reasons, he resisted the bail application.

Heard. Perused the papers. Informant Jagdish Sharma approached M.I.D.C. Police Station on 15.01.2025, and reported that, he runs a Computer Shop for is livelihood. That, on 09.01.2025, after borrowing gold loan to the tune of Rs.2,00,000/-, he paid Rs.50,000/- to Mahadeo Bajade on next day, i.e. on 10.01.2025, and remaining Rs.1,50,000/- was kept in the bag in his WagonR Car. He further reported that, on 14.01.2025, he visited the pan stall owned by one Hanumant Pade. After eating betel nut, returned to his vehicle for paying the pan stall owner, took out some cash from the vehicle, that time, he saw some persons quarreling with pan stall owner. He came back and go to his house, at that time, his vehicle was intercepted by four unknown persons, scuffled with him, and took out Rs.60,000/- from his hip pocket and snatched cash bag kept in the vehicle. He claims to have taken the names of those four persons, who quarreled with pan stall owner, and on the basis of the same, he lodged report against Munna Kamble and Tukaram Salunke (present applicants) and Suraj. 5.
Statement of Hanumat Pade is also recorded by police. In his statement to the police, he also reported an incident dated 14.01.2025, which allegedly occurred with the informant at his
{4} pan stall. One accused is still at large. Learned APP has made a statement that, there is CCTV footage. Seven and three crimes are registered under the belt of applicants No.1 and 2, respectively. Charge-sheet is yet to be filed. Therefore, in the light of above material, this Court does not deem it a fit case to grant bail at this stage. Hence the following order:
ORDER
Bail Application is rejected.
