Mr. Jadhav, learned counsel for the petitioners submits that petitioners have applied for tribe certificate in September, 2016. The Sub-Divisional Officer has to decide the said application within 45 days, however, the same is not yet decided.

In absence of the tribe certificate the petitioners are not in a position to get the benefit of reservation category.

Learned A.G.P. submits that in case application filed by the petitioners is pending with the Sub-Divisional Officer, then the SubDivisional Officer would decide the same on its own merits, expeditiously.

Considering the above, we pass following order.

Respondent no.2-Sub-Divisional Officer shall decide the application filed by the petitioners for issuance of tribe certificate, expeditiously, preferably within two months from today.

Writ Petition accordingly disposed of. No costs.
