It appears, subject of course to the facts, having regard to that it is being contended that more than two-third majority has passed no confidence motion, prohibition pursuant to section 35 (3-A) of the Maharashtra Village Panchayats Act, 1959 on subsequent no confidence motion within a year, may not apply in the present case.
