Mr P.B. Patil, Advocate holding for Mr H.P. Deshmukh, Advocate for Petitioners Mr P.S. Patil, Addl. G.P. for Respondent-State CORAM : S.V. GANGAPURWALA AND SHRIKANT D. KULKARNI, JJ.
DATE : 30th JANUARY, 2020 PER COURT :
1.
Mr Patil, the learned Counsel for the petitioners submits that the petitioners are issued with the caste certificates of 'Tokare Koli' Scheduled Tribe. The petitioners applied for verification of the caste certificates with the Committee. The Committee only refused on the ground that the caste certificates are not issued in Form-C.
2 904-WP-1961-2020 & Anr. The petitioners applied in February and March, 2018 for issuance of the caste certificates in Form-C, but the Sub Divisional Officer is asking for evidence prior to 1950.
2.
We have heard the learned Additional Government Pleader.
3.
If the authority has already issued the caste certificates to the petitioners and if the candidate requires the certificate to be issued in proper Form-C, then the competent authority is not again required to ask for the evidence. It shall only verify about the genuineness of the issuance of the earlier caste certificates and if the competent authority is satisfied with the earlier caste certificates issued by his office, then has to issue the caste certificates in proper Form-C.
4.
The Sub Divisional Officer shall upon verification of the fact that the earlier caste certificates were issued by the competent authority, shall issue the caste certificates to the petitioners in FormC. The said exercise shall be done within a period of six weeks. 5.
The writ petition as such is disposed of. No costs. [ SHRIKANT D. KULKARNI, J. ] [ S.V. GANGAPURWALA, J. ] mta
