Heard the learned counsel for the applicant and the learned A.P.P for respondent/State.

The allegations in the first information report reveal that a car in which the applicant was traveling dashed the bike of the injured. The applicant and the first informant were not knowing each other. They have no transaction or business before the incident. Therefore, it is a matter of trial whether there was an intention to kill. Prima facie it appears a road traffic accident. The vehicle allegedly dashed the bike has been seized. Nothing is to be recovered from the applicant. The applicant deserves bail. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) Applicant Pappu s/o. Sunil Sonkambale be released on bail on furnishing P.B.and S.B. of Rs. 50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in C.R.No.180 of 2019 registered with Police Station Waluj, District Aurangabad, for the offences punishable under Sections 307, 120B read with Section 34 of the Indian Penal Code, on the conditions that, (a) He shall not to tamper with the prosecution witnesses. (b) He shall attend the trial on each and every effective date. (c) He shall not involve in the similar crime. ( S. G. MEHARE ) JUDGE ysk
