Learned Advocate for the Petitioner submits that order passed on application Exhibit-5 has been challenged in the present Petition which is arising out of Regular Civil Appeal No. 302 of 2014.

Learned Advocate for the Petitioner submits that Regular Civil Appeal No. 302 of 2014 itself has been dismissed by the Appellate Court for want of prosecution, by order dated 13th November, 2018. According to his instructions, the Appeal has not yet been restored. Learned Advocate tenders certified copy of order dated 13th November, 2018 which is taken on record and marked "X" for identification.

In view of dismissal of the Appeal itself, nothing survives to
