Mr. Bajaj, learned counsel submits that during pendency of this Writ Petition, the

wp595.04 Petitioners have issued notice under Section 127 of the Maharashtra Regional and Town Planning Act in the year 2011, and as such, on instructions states that the Petitioners may be allowed to withdraw the present Writ Petition with liberty to take proceedings pursuant to the notice under Section 127 of the Maharashtra Regional and Town Planning Act.

We have heard Mr. Patil the learned counsel for Respondent No.6 and learned A.G.P. for Respondent Nos. 1 to 5.

In light of the above, the Writ Petition is disposed of as withdrawn with the liberty as aforesaid. No costs. Rule discharged.
