Heard Mr. Mayure, learned counsel for the applicant and Mr. Deshmukh, learned counsel for respondents. The proceedings were decided ex-parte. There is on record a certificate to indicate that the applicant was on duty in District Gadchiroli for over 172 days. Mr. Deshmukh, learned counsel for the respondents vehemently opposes to allow the application.

Since the proceeding has been decided ex-parte

and the reasons for non-appearance of the applicant before the trial Court is said to be, he was on duty in naxal affected area i.e. in Gadchiroli district, it is desirable to allow this application and grant him opportunity to represent himself in the proceedings before the trial Court.

In view of the above, the revision application is allowed in terms of prayer clause (C). The trial Court is requested to dispose of the matter on merits within a period of four months from the date of receipt of this order. ( R. G. AVACHAT ) JUDGE fmp/-
