Learned counsel for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to file Appeal before the District Court, Aurangabad. Allow to withdraw with liberty as prayed for.

Principal District Judge, Aurangabad is directed that in case such Appeal is preferred along with the application seeking dispension of filing of certified copy of Award, the same be considered in view of the peculiar facts of the case that the Arbitrator who has passed Award is no more alive and the petitioner is unable to produce copy of the Award signed by the Arbitrator.
