VERSUS

THE STATE OF MAHARASHTRA AND OTHERS Mr.Suvidh S. Kulkarni, Advocate for the petitioner Mr.A.R.Kale, AGP for the respondents/State Mr.S.B.Pulkundwar, Advocate for respondent Nos.2 to 4 CORAM : PRASANNA B. VARALE & S.M.GAVHANE,JJ.

DATED :

06.03.2019 P.C. :- .

Heard learned counsel for the petitioner.

2.

The petitioner is challenging the order passed by the Chief Executive Officer, Zilla Parishad, Nanded

( 2 ) dated 15.02.2019 whereby the petitioner is transfered from Zilla Parishad Primary School Talbid Tq. Naigaon to Zilla Parsha Primary School Saranjani, Tq. Mahur. Learned counsel appearing for respondent No.2 Zilla Parishad, Nanded placed on record corrigendum issued to the Government Resolution dated 27.02.2017 the same is taken on record and marked as "X" for identification. 3.

Perusal of the corrigendum shows that by this corrigendum the State Government is making cautionary measure and thereby the Divisional Commissioner to lookafter the transfer matters so as to remove doubts of irregularity in transfer matters. In clause-6 of the corrigendum it is stated that the Divisional Commissioner to conduct enquiry in the matter of a transfer order if a grievance is raised and to pass order within stipulated period of thirty days and the decision of the Commissioner would be final. This clause clearly is making available grievance redressal in respect of the transfer. As the petitioner who is having grievance about his transfer can certainly approach the Divisional Commissioner by way of an application or representation and as this alternate remedy being provided by the State Government to the petitioner and alike the teachers, we see no reason to entertain the petition and with liberty

( 3 ) to the petitioner to approach the Divisional Commissioner, the petition is disposed of.
