The wife is seeking transfer of a divorce proceeding initiated by the husband pending in the Family Court, Ahmednagar to the Family Court Pune.

I have heard both the sides and perused the papers. 3.

There is no dispute about the fact that the applicant has been staying in Pune whereas the respondent is a resident of Ahmednagar. There is no dispute about the fact that he has instituted a divorce proceeding at Ahmednagar whereas she has initiated a proceeding under the Protection of Women from Domestic Violence Act, 2005 which is pending in the Court at Pune. Besides she has also filed a criminal case for the offences punishable under Section 498-A etc. of the Indian Penal Code in Bhosari Police Station, Pune.

Needless to state that the respondent will have to attend the matters in the proceeding initiated by the applicant by going to Pune. 1/2

It would be appropriate that all the matters between the parties remain at one place which would be convenient for both of them to attend to. A possible hardship to the respondent can be obviated by directing the courts to take up all their matters on the same date. 6.

The Application is allowed. The matter is transferred to the Family Court Pune. All the courts taking up different matters between the parties at Pune, shall, as far as possible list all that matters on the same day. Parties shall appear before the Family Court Pune on 30.07.2022 and there shall be no need for that court to issue notices to them. (MANGESH S. PATIL, J.) habeeb 2/2
