Pursuant to our order dated 16.3.2023, the learned A.G.P. informs us that unless there are two contradictory proposals received by the department from two warring factions, the objection that there is a dispute amongst the managing trustees would not prevail upon the decision making authorities of the Joint Director, Higher Education, Aurangabad.

The learned A.G.P. representing Respondent No.3 places on record two copies of communications addressed to him, dated 23.3.2023 and addressed to the Petitioner, dated 21.3.2023. Both the communications are taken on record and marked as "X-1" and "X-2", respectively, for identification.

He submits on instructions that the Petitioner management can send a fresh proposal even within 48 hours, via the online portal and the same would be considered on it's own merits, without considering the internal squabbles of the management, since there are no contradictory proposals received by the authorities. 4.
The learned advocate for the Petitioner submits on instructions that the Petitioners are agreeable. 5.
As such, this Petition is disposed off. The management would forward an online proposal for appointment of Principal and the competent authority would consider the same in accordance with law. The decision thereon shall be announced by the concerned authority, on or before 30.04.2023.
