The State of Maharashtra ..Respondent -- Mr.V.D.Salunke, advocate for applicants Mr.S.P.Dound, AGP for respondent -State -- CORAM : M.T. JOSHI, J.
DATE : MARCH 10, 2015 PER COURT :
Heard both sides.
2] In fact, the earlier applications of the present applicants bearing Criminal Application Nos.5728 of 2014 and 5729 of 2014 were disposed of as withdrawn by this Court on 10th November, 2014, by continuing the interim protection only for a period of two weeks.
2 1-crappln1146-15.odt 3] In that view of the matter, there was neither reason for the applicants to file fresh application for anticipatory bail before the Sessions Court nor the learned Sessions Judge was required to give any reason regarding filing or non-filing of the charge sheet.
4] The applicants would always be at liberty to surrender before the appropriate authority i.e. either before the sessions court or before the police and upon failure, the Investigating Officer is also at liberty to arrest the applicants.
5] In that view of the matter, nothing survives in the application.
The application is, therefore, rejected.
