Heard learned counsel for appearing parties.

Perused the application.

For the reasons stated in the application, the same is allowed in terms of prayer clauses "B and C". The delay caused in bringing the legal representatives of deceased respondents No. 1, 2, 5, 8, 11, 12, 13 and 15 stands condoned. Abatement of the proceedings to that effect also set aside. The appellants to carry out requisite amendment within two weeks from the date of order.

After requisite amendment, issue notice to the L.Rs. of deceased respondents No. 1, 2, 5, 8, 11, 12, 13 and 15. 5.

Mr. Nirmal, learned counsel waives service on behalf of L.Rs of deceased respondents No. 1, 2, 5, 8, 11, 12, 13 and 15. 6.
