Per Court :- Present Criminal Application is filed by the applicants for grant of anticipatory bail, since they are apprehending their arrest in connection with M.Case No.253/2014 registered with Police Station, Osmanabad (City), Dist. Osmanabad for the offences punishable under Section.s. 467, 468, 471, 420 read with 34 of the Indian Penal Code.
[2] Heard Mr. Mayur Salunke, learned counsel for the Applicants and Mr. M.M. Nerlikar, learned Additional Public Prosecutor for the State.
[3] Looking to the nature of accusation made against the present applicants, it is absolutely clear that, alleged offences pertains
2/3 to the document and those documents are not in custody of present applicants.
[4] Mr. M.M. Nerlikar, learned Additional Public Prosecutor submitted that, custodial interrogation of the applicants is necessary in order to have specimen signatures and specimen handwriting of the applicants. However, this court is of view that, same can be taken care by directing the present applicants to give their specimen signatures and specimen handwriting to the Investigating Officer and for that purpose, custodial interrogation is not necessary. [5] Looking to the nature of the allegations made against the present applicants, their custodial presence is not at all necessary. Hence, I pass the following order :-
ORDER
(i) Criminal Application is allowed.
(ii) In the event of arrest, Applicant No.1 Shantinath Murlidhar Jadhav, Applicant No.2 - Tukaram Bhagwan Dhanake, Applicant No.3 - Suresh Pandurang Bhokre and Applicant No.4 - Swapnil Dhanyakumar Jadhav shall be released on anticipatory bail on they executing P.R. Bond of Rs. 5,000/- [Rs.Five Thousand] each with one solvent surety in the like amount, in connection with M.Case No.253/2014 registered with Police Station, Osmanabad (City), Dist. Osmanabad for the offences punishable under Section.s. 467, 468, 471, 420 read with 34 of the Indian Penal Code.
3/3 (iii) The Applicants to attend Police Station, Osmanabad (City), Dist. Osmanabad and extend co-operation to the Investigating Officer by giving their specimen signatures and specimen handwriting on 26th March, 2015. (iv) The applicant shall also continue to extend their cooperation to the Investigating Officer and shall attend the Police Station Osmanabad (City) as and when required by the Investigating Officer, after receipt of written communication from the Investigating Officer. (v) With this Criminal Application is disposed of. (V.M. DESHPANDE, J.)
