Mr. Gujrati, learned AGP, on instructions of Mrs. Charushila Tambekar, Joint secretary, Food, Civil Supplies & Consumer protection Department, Mantralaya, Mumbai submits that unless and until the draft rules are finalized, no steps will be taken for promoting the persons to the post of Inspector, Legal Meteorology, Class-B Category. Original application filed by the petitioners is pending before the Tribunal. It is only against the issuance of notice, the petitioners have approached this Court.

In view of the statement made by the learned A.G.P., immediate apprehension of the petitioners does not survive. The petitioners may prosecute their original application with the Tribunal.

Writ petition is accordingly disposed of. No costs.
