1] Heard learned counsel for the applicant and the learned APP for the respondent-State.

2] The applicant is apprehending arrest in connection with Crime No.0839/2024, registered at Rahuri Police Station, District Ahmednagar, for the offences punishable under Sections 3, 4 and 5 of the Immoral Traffic Prevention Act, 1956.

3] The learned Senior Advocate appearing for the applicant submits that in the hotel property raid was conducted and the lessee, who runs the hotel in the premises of the applicant was found conducting the illicit business of brothel. He submits that the person running the

business has been arrested. He also submits that his statement was recorded by the police in the course of investigation, when the notice was issued under Section 41(a) of the Cr.P.C. He submits that the applicant has ownership of the premises. His custodial interrogation in the matter is not required and the investigation is nearing completion.

4] Considering the nature of offence so also considering that there are no antecedents against the applicant and the applicant has leased the property to the co-accused, the interim relief, granted earlier can be confirmed.

5] In view of the above, the interim protection granted by order dated 06.03.2025 stands confirmed, on the following terms:

i] The applicant shall attend the concerned police station on 19.03.2025 and 20.03.2025, between 10:30 a.m. to 01:30 p.m.

ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.

iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.

6] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.

7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

8] The application stands disposed of.
