Applicant apprehends arrest in Crime No.285 of 2023 registered with Pundlik Nagar Police Station, Aurangabad for offence punishable under sections 307, 120-B, 201 read with section 34 of the Indian Penal Code and under sections 3/25 of Arms Act and under section 135 of the Maharashtra Police Act. 2.
FIR is lodged by Prabhu Ananda Ahire alleging that on 31.07.2023, at about 4.30 p.m., when he was sitting in his house and his wife was in the kitchen, one person aged 25 to 26 years entered inside their house and fired two bullets from a pistol towards him. On that time, he got down and saved himself from the bullet, but one bullet was struck on the wall. S.P. Rane

Heard learned advocate for applicant and learned APP for respondents - State. Perused the Investigation papers. 4.
Charge-sheet in the present crime is filed on 26.10.2023. Three accused persons against whom main allegations are levelled, are already arrested. So far as applicant is concerned, only allegations levelled against him is that he has accepted amount and had delivered it to the accused. Except that his active role in commission of the alleged offence is not seen from the charge-sheet. 5.
Applicant was granted interim protection and he has co-operated in the investigation. In view of filing of chargesheet, no useful purpose would be served by remanding applicant to the custody at pre-trial stage.
