The learned counsel submits that while granting Rule, this Court by order dated 11.04.2008 has observed that the impugned order passed by the Assistant Registrar, Co-operative Societies, Majalgaon, District Beed is patently erroneous. The learned counsel submits that the question involved in this Writ Petition is thus required to be decided.

On perusal of the contents of the Writ Petition and annexures, it appears that this Writ Petition pertains to the nomination filed by Respondent No.1 for contesting the election of Vividha Karyakari Sahakari Seva Society for the year 2007 to 2012. The petitioner had raised objection and

907-WP.2579-08.odt though the Returning Officer on the basis of the objection raised by the petitioner has rejected the nomination form, in the appeal, Respondent No.3 by impugned order allowed the said appeal. However, the petitioners are at liberty to raise this point by filing the Writ Petition in any other matter if occasion so arises. However, by efflux of time, this Writ Petition has become infructuous.

The Writ Petition is hereby dismissed as infructuous. Rule discharged.
