Challenge in this petition is the order passed by 2nd Joint Civil Judge, Junior Division, Tuljapur, below Exhibit-109 in Regular Civil Suit No. 171/2014, thereby refusing permission to the defendants to amend their written statement to file counter claim against the plaintiffs.

At the outset, learned advocate for the petitioner on instructions submits that subsequent to the filing of present petition, defendants have filed Special Civil Suit No. 166/2022 for the relief sought to be claimed in the counter claim. Therefore, he has instructions to withdraw the petition. He therefore seeks permission to withdraw the petition. 3.

Permission granted.
