By order dated 27th February, 2014 (passed by Shri A. V. Nirgude, J.) the second appeal was dismissed by a detailed order, in absence of the petitioner. Thereafter, by order dated 27th April, 2022 (passed by Shri Mangesh S. Patil, J.) the second appeal is restored as the petitioner had not concluded his arguments and the second appeal was dismissed before the conclusion of arguments of the petitioner. While restoring the second appeal, it was observed that no adjournment would be granted.

On last occasion when the matter was listed on 24/07/2023 the learned Advocate for the appellant was absent. Today also none present for the parties on the second call also. 3.

In view of the above, the second appeal stands dismissed in default.
