Heard learned Counsel for the applicant - wife. The respondent - husband, though served with notice but remained absent.

The applicant - wife is seeking transfer of Hindu Marriage Petition No. 8 of 2023 pending in the Court of C.J.S.D., Udgir, Dist. Latur filed by respondent - husband for getting divorce, to the Court of C.J.S.D., Kandhar, Dist. Nanded.

According to the applicant - wife, she is not having any independent source of income. Moreover, she has also filed proceedings under the provisions of Protection of Women from Pooja K.

968-MCA-67-2023 Domestic Violence Act, 2005 against the respondent - husband and his family members and one criminal prosecution under Section 498 - A of IPC is also going on. 4.

There is no opposed to the application and the respondent - husband will have to attend the dates at Kandhar, Dist. Nanded in the proceedings filed by the applicant - wife. As such, considering the convenience of applicant, following order is passed :

ORDER

(i) The application is hereby allowed.

(ii) Hindu Marriage Petition No. 8 of 2023 pending in the Court C.J.S.D., Udgir, Dist. Latur is transferred to the Court of C.J.S.D., Kandhar, Dist. Nanded for disposal according to law.

(iii) The respondent is directed to appear before the Court of Civil Judge Senior Division, Kandhar, Dist. Nanded on or before 8th August, 2023.
