PER COURT :- 1.

This matter has been heard for sometime and the past service record is also perused while scrutinizing the impugned concurrent findings of the Labour and Industrial Courts. 2.

Since this Court is not inclined to entertain this petition, learned counsel for the petitioner submits that the Labour Court may be directed to consider the entire grievances of the petitioner set out in Complaint (ULP) No.47 of 2015 on their own merits.

Considering the above, this petition is disposed off without interfering with the impugned order.

By consent of the parties, pending Revision (ULP) No.11 of 2018 before the Industrial Court at Jalna stands disposed off. 5.

It is expected that the Labour Court, Nanded would consider the pending (ULP) Complaint on it's own merits, keeping in view the past service record of the petitioner and in the light of the law laid down by the Honourable Apex Court in the matters of Divisional Controller, KSRTC Vs. A.T.Mane [(2005) 3 SCC 254] and KSRTC Vs. B.S.Hullikatti [AIR 2001 SC 930 = (2001) 2 SCC 574].
