Heard learned Counsel for the applicant - wife. The respondent husband, though served with notice, but remained absent.

The applicant - wife is seeking transfer of Marriage Petition No. 5 of 2023 pending in the Court of CJSD, Malshiras, District Solapur filed by respondent - husband for getting divorce, to the Family Court, Ahmednagar.

According to the applicant-wife, she is not having any source of income. Moreover, she is pregnant from the respondenthusband. The distance between Malshiras and Ahmednagar is more than 200 Kms and therefore, it would be difficult for the applicant to attend the dates at Malshiras without any financial support. Moreover, she has also filed proceedings against the respondent - husband at Ahmednagar under the provisions of PWDV Act. There is no oppose to this application and therefore, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

2 958 mca 60-23 (ii) The Marriage Petition No.5 of 2023 pending in the Court of CJSD, Malshiras, District Solapur is transferred to Family Court, Ahmednagar for disposal according to law.

(iii) The respondent is directed to appear before Family Court, Ahmednagar on 15/07/2023.

(iv) The application is disposed of accordingly.
