Respondent no.3 is personally present in the court. He has tendered unconditional apology and pointed

ca3213.15 out that he was transferred from Nanded to Parbhani and the notices of the contempt petition reached to Nanded and the said fact was not pointed out to him and that is the reason on 10.2.2015 he was unable to attend this court. The unconditional apology and the explanation given by the respondent no.3 Shri B.R.Kundgir, who is present in the court are accepted.

2] In that view of the matter, the order, dated 10.2.2015 issuing the bailable warrant against Shri B.R.Kundgir is hereby recalled and the Civil Application No. 3213 of 2015 is disposed of accordingly.
