Present application is for condonation of delay of 356 days caused in filing appeal by the original claimants.

Learned counsel for applicant submits that applicant was unaware of the legal proceedings and period of limitation for filing appeal. That, due to financial crises he could not file appeal within time. That, delay caused in not deliberate and intentional. For above reasons, he prays to condone the delay. 3.

Learned counsel for respondent no.2 opposed application. 4.

In view of above submissions and for the reasons mentioned in the application, application is allowed in terms of prayer clause (B). Delay caused in filing the appeal is condoned. Appeal be registered. On registration of appeal, issue notice to the respondents. Learned APP waives service of notice for respondent no.1.
