Learned Advocate for the petitioners, on instructions, seeks withdrawal of petition with liberty to move learned Sessions Court, Jalna for bringing Summary Criminal Case Nos.999/2020, 1000/2020, 1001/2020 and 1170/2020 under one roof, as all the matters are before different Judicial Magistrates at Jalna. He submits that in all the cases the petitioners are the accused persons and those cases are under Section 138 of the Negotiable Instruments Act. The defence that would be taken by the petitioners in all the cases would be same and, therefore, it would be appropriate to bring all those cases in one Court.

Cri.WP_345_2022 Taking into consideration the prayer for the liberty, definitely, it appears to be a reasonable prayer, which can be considered by the learned Sessions Judge. Under such circumstance, the petition is allowed to be withdrawn with liberty as prayed. Learned Sessions Judge may consider it as per the provisions of law.
