This is an application under Section 438 of the Code of Criminal Procedure, as the applicants are apprehending their arrest in connection with Crime No. 431/2020 registered with Udgir (Rural) Police Station, Taluka Udgir, District Latur, for the offences punishable under Sections 302, 304-B read with Section 34 of the Indian Penal Code.

After having heard both the sides, it transpires that one Anil Vishwanath Bande and his wife Prabhavati Anil Bande have been granted anticipatory bail by this Court in ABA No. 1237/2020 by the order dated 29.01.2021 i.e. at Exhibit 'C'

Going by the allegations being levelled in the FIR and the prosecution case, the role attributed to Anil Vishwanath Bande and
909ABA204 his wife Prabhavati Anil Bande and that to the present applicants is exactly pari materia.

In view of such state of affairs, for self same reasons as are mentioned in the order dated 29.01.2021, the present application is allowed.
ORDER
1.
Applicant Nos. 1 and 2, in the event of their arrest in connection with Crime No. 431/2020 registered with Udgir (Rural) Police Station, Taluka Udgir, District Latur, for the offences punishable under Sections 302, 304-B read with Section 34 of the Indian Penal Code, be released on furnishing Personal Recognizance bond of Rs. 15,000/- (Rupees fifteen thousand) each with one solvent surety each in the like amount and on condition that they shall not interfere in the investigation, shall not pressurise the witnesses and shall remain present before the Investigating Officer as and when called upon to do so.

Application stands disposed of accordingly.
