Mr. Barde, learned counsel for respondent no. 4 submits that the petitioner had already filed proceedings under Section 33C (1) of the Industrial Disputes Act, 1947, before the Labour Commissioner. Pursuant to the Recovery Certificate the amount is recovered along with interest at the rate of 9% per annum. The amount of Rs.3,33,156/- is deposited as payable to the petitioner and earlier also part payment was made. The respondents have complied with the payment of retiral benefits.

In the light of above, purpose of the writ petition stands served.

In case the petitioner is aggrieved with regard to the quantum, the petitioner had already filed proceedings under Section 33C (1) of the Industrial Disputes Act, 1947. 4.
